SERVICES TO BE PERFORMED

The contractor agrees to perform the following services:

  1. This plan includes one half hour each month of features, fixes, and updates. For example, image swaps, text changes, or additional new factors that do not currently exist on the website.
  2. Hours roll over from the date of the signature if not used. However, they do not extend beyond a 12-month period.
  3. Each month accrues 1 half hour from the signature month. These hours roll over for a 12-month period and then restart. These hours can be used for website work other than general maintenance as well. For example, maintenance is typically 0.25–0.5 hours per month. This gives a range of hours for labor that can be used for other work beyond just typical website maintenance.
  4. This maintenance plan is on call within 30 minutes of reasonably received communication (10 PM–8 AM do not count as reasonable).
  5. Additionally, marked for the client is a review of their yearly hosting plan and domain name registrar to make sure the price increases aren’t price gouging the client. This often happens when a new site is created, domain cost and hosting cost is initially cheap and then after the first 12 months those prices exponentially rise. I will discuss with the client and speak on their behalf on either lowering the cost from the current provider or switching the hosting to a better deal. This is a bad practice in the industry to lure lower cost hosting initially and then gouge them after the first year. This feature alone can sometimes save the entire payment cost for the maintenance plan itself!

PAYMENT COSTS

The client will pay $250.00 for 12 hours of maintenance and additional(s) to be used, accordingly, once per year. The client shall pay the contractor before the maintenance plan is initiated. This is a one time payment for the entire 12 month period.

STATE AND FEDERAL TAXES

The contractor is responsible for withholding FICA, Social Security, and Medicare taxes from client payments, or making FICA payments on the client’s behalf.

TERM OF AGREEMENT

This agreement will become effective when signed by both parties. This is a month to month contract and may be canceled or extended at client’s discretion.

This agreement will be governed by Kentucky law without giving effect to conflict of law principles.

MODIFYING THE AGREEMENT

This agreement may be modified only by a written agreement signed by both parties.
